Motion for Rehearing Denied
On October 25, 2012, the Ninth Circuit denied CIR’s appeal on behalf of Corissa and Eric Mueller. CIR previously appealed District Court Judge Lynn Winmill’s decision to deny a new trial in the Mueller’s parental rights case. A three judge panel of the Ninth Circuit affirmed Judge Winmill’s opinion. Afterward, CIR appealed the panel decision to the whole Ninth Circuit Court of Appeals, which denied the appeal.
CIR filed the case in 2004 after Idaho officials took custody of the Muellers’ daughter and gave her medical treatment without their consent. The Ninth Circuit’s decision brought CIR’s representation of Corissa and Eric Mueller to a close.
